| This paper focuses on land allocation of Wang Cun in response to that land ownership construction strategy is not unilateral arrangement of the state system, but conbined with the local economy, culture and customs together. Farmers on land policy is not a passive recipient, but also is a constructors to use, "reform" the land. As a result, the land right shows the characteristics of mutual construction between national and local government. In addition, from contract right of the "15 years", "30 years" to "long-term" until the "property" of the system transform, collective ownership is constantly being challenged in practice. At the same time, the right of the village community is transformming to individual rights, and peasants is changing their cognition of the land accordingly.Following the time line, this paper firstly presents, before "defining rights, defining land", the land allocation of Wang Cun in order to show the original appearance of collective land ownership. Since the tax reform started, land dispute emerges from wildland and land agent after a reversal of the land market. In view of this, Hubei Provincial Government issued a notice of "Opinions on Second-Round Contracting Improvement in Rural Areas". This notice can not match with local government. "One-Size-Fit-All" system arrangements strongly conflict with parochial land cognition of farmers. Farmers and village leaders compete for land ownership, which represents local features of land right construction. However, the land policy, after "defining rights", also has a local "alternative" nature, embeding in land system based on the governance. In the process of "power to the people", village cadres'rights to land is been weakened, and the lack of governance led to a large number of sales on illegal land and building. In addition, after collective assets flew into market, collective ownership crushed in front of farmers.These phenomena presents village land system in a micro way. And it doesn't mean the answer to problems of land system reform, but by the way that farmers treat the existing land demonstrates that land ownership construction is a mutual integration between national and local . This integration should be treated as an important factor in futrure land system reform. |
