Nominated subcontract is originated in the United Kingdom, then gradually become the international popular subcontract model. With the opening of our country's construction market, nominated subcontract become more and more popular the domestic construction, and with growing trend. According to our country's laws, regulations and relevant specification, nominated subcontracting is " illegal", but nominated subcontract contract is still valid. This seemingly incongruous phenomenon leads to lack appropriate guidance in use and series problems, which affect the project construction, also disrupt the normal order of the construction market.This theme, which based on the analysis of the domestic and foreign research results, is aim to study nominated subcontract phenomenon and contract management in our country and attempts to design nominated sub-contract structure, through theoretical analysis, semi-structured interview survey method and comparative method, to provide reference for the management of nominated sub-contract and promote construction market developed healthy and orderly.The paper, as the research object with the nominated subcontract phenomenon in the engineering construction, through semi-structured interview survey method investigating the current situation at first, analyze the existing problem, put forward the necessity of standardize the behavior of nominated subcontract. Secondly, combined contract efficiency theory, put forward the nominated Sub-Contract applicable range and contract system, suggests that owner, contractor and nominated subcontractor signed tripartite agreement, and analyzed nominated sub-contract management process and the significance of the management in detail; then, propose some feasible suggestions respectively from the nominated subcontracting bidding, sign of the total contract, the nominated Sub-Contractor 's tripartite agreement; at last, redesign the nominated Sub-Contractor's tripartite agreement; and put forward proposal amendments on nominated subcontract common and special terms in reference to our country's "construction engineering subcontract (demonstrative text)".The main disadvantages of the themes is that the universality and comprehensive of the research remains to be improved, which only through exchanging with the well-known domestic scholars and some engineering employees to get valuable communication, because of the scarce statistical data of our country construction and the author own lack of enough practice experience.
