The employment is vital to the livelihood of people. Along with the further deepening of economic and social transformation, our country's employment situation is stern day by day. Laid-off workers, rural migrant workers and other new labor force constitute our country's employment pressure currently. In addition, over-reliance on the employment pattern that the formal sectors absorb labor forces solidified the employment pressure. With the deepening of market-oriented reforms, a new form of employment--flexible employment has been generated and developed gradually. Due to its vast areas of employment, flexible and diverse types of employment, lower threshold of employment, flexible employment has developed fast in China. Flexible employment has become an important channel to add new employed position and ease employment pressure.Flexible employees have become an increasingly large group of our country that can't be ignored: flexible employment has also become the important management area that the government can't avoid. China's current institution supply shortage and institution supply excess limit the capacity and potential of flexible employment to absorb labor force; the development of flexible employment is serious constrained. If the government, as the main body of institution supply, could provide the scientific, rational and effective institution, the development of flexible employment would be regulated and promoted to a large extent.According to labor economics theory and institution economics theory, the paper constructs theoretical model of relationship between flexible employment and institution supply. Then the paper draws the conclusion that effective institution supply has a positive impact on flexible employment. On this basis, the paper analyses the overview of flexible employment in China and institution supply of China's flexible employment, and reveals that the institution of employment support, the institution of labor rights, and the institution of the social security are deficient, as well as that the institution of household registration and the institution of urban management and law enforcement is surplus. Aiming at these issues, combined with our national conditions, and proposed effect institution supply which promotes China's flexible employment, including normative institution supply, protective institution supply and supportive institution supply.
