The resource-based city is growing up with the exploitation and utilization of the naturalresources in the course of human economic and social development. Each resource-based cityhas its life cycle that includes the process of its rise, development, great prosperity and decline ofthe process. When the natural resources which human beings depend on to live were used up ,thesocial economy began to decline, ecological environment were severely damaged, the economywere developing slowly and social problems occurred frequently. Just at this time theresource-based city turned into resource-exhausted city. Many countries in the world are facingthe problem how to the sustainable development of the city and how to achieve timelytransformation when the resource are depleted. Compared with that of the developed countries,resource-exhausted cities in our country face more serious contradictions and problems. How topromote the resources-exhausted city smooth transition, and realize the sustainable developmenthas become the urgent need of China’s economic and social development. This paper standing inthe aspect of law, put forward some suggestions, for the sustainable development ofresources-exhausted city, and in full consideration of the area’s overall and long-termdevelopment basis, promotes economy, society, resources and environment of theresources-exhausted city comprehensive and coordinated development. This text will accordingto the basic theory of sustainable development, combining with the practical development of theresource-exhausted city, research the special problems of resource-exhausted cities in thesustainable development. In addition, Studying the sustainable development theory andimplementation approach of resource-exhausted city from the legal system perspectives, willprovide the theory basis and the practical policy recommendations for the sustainabledevelopment of resource-exhausted cities in our country.This thesis includes four parts:PartⅠ: The theory basis of resource-exhausted city sustainable development. This part is atheoretical foundation and logic starting point of the full text. First of all, this paper expounds theconcept and characteristics of the resource-exhausted cities. Secondly, the connotation ofresources-exhausted city sustainable development and the relationship with economictransformation will be introduced, and then analyzing the necessity and feasibility ofresource-exhausted city sustainable development. Lastly, the author analyzes the theory basis ofresource-exhausted city sustainable development. PartⅡ: The law and policy experience of the sustainable development of foreignresource-exhausted cities. This part firstly introduced the valuable experience ofresources-exhausted city in foreign that has been accumulated in the process of transformation.Then, the article analyzes the significance and reference that these successful experiencesprovide to our country.PartⅢ: Main legal barriers of the sustainable development of resource-exhausted cities inChina. Through analyzing the present situation and existing problems of resource-exhaustedcities in our country, sums up the mainly legal barriers that blocks sustainable development ofeconomic and social in city. It includes three aspects: the defects in the legislation, not a soundlegal system, imperfect law enforcement and supervision mechanism.PartⅣ: The perfect measures of the sustainable development of resources-exhausted citiesin China from legal perspective. This part is a heavy difficult point of the whole text, and thetheory homes and temporary lodgings of the full text at the same time. This part is based on thesuccessful experience in policy and law aspects of foreign countries to improve the legalcountermeasures of the sustainable development of resources-exhausted cities in China. The firstis establishing the fundamental principles of sustainable development in law. Next, it is theperfection of the legislative system. Then, we should improve relevant legal system. Finally, thelegal enforcement and surveillance mechanism should be strengthened.
