Government Environmental Regulation In Use Of Sea Areas In China

With the implementation of the strategy of marine economy, all kinds of theconflicts in marine area development in the process emerged. According to the actualconditions of our country, combined with the use of sea of success in managementexperience, lessons and related theory basis, to change the sea to attribute, marineresources, marine ecological effects of large sea area use the regularity of project, thestandardization of management action, to the use and management of sea areas ofmarine resources standardization, scientific and reasonable development of the marineenvironment and sustainable development of great significance.First section of this paper analyzes the theory of marine area use management.Second, the use of sea areas the government environment control of the subject, objectstudied respectively. Government is marine environment control in the concentration ofpublic interest, maintenance and distributor, the enterprise is in the Marine environmentcontrol partners, the enterprise production process and related behavior is governmentenvironment control objects. For the government, enterprise sea area use of the role ofthe localization, this paper studies the use and management of sea areas thegovernment in environmental regulation and the relationship between the enterprise:the use of sea areas the government over the enterprise and the supervision is the basisof implementing control measures, the government to enterprise’s guide and promotethe incentive is to transfer control information, government and enterprise relations ofcooperation. Third section introduces and analyses government environment regulationtools in marine area use. Points out three types in the sea area use of governmentenvironmental regulation: command control type, the motivational type, voluntary type.Command control type mainly includes: legal policy, administrative, standards;motivational methods include: economy, propaganda education, scientific technology;Voluntary type including: environmental information disclosure, and environmentalperformance management, voluntary environmental agreement. Put forward in the seaarea use government means the trend of the development of the environmental regulation shall be determined by the command control type to the motivational,voluntary type.Finally, this article through10provinces’ present situation in marine environmentregulation reflect that the government is not clear influence government responsibilitiesthan Marine environment regulation efforts, the development model is not reasonable,evaluation mechanism is misguided marine environment regulation of institutionalfactors, lower benefit. In view of the above, the problems of regulation in the marinearea use should change in this way: conception, tools innovation, multiple subjectparticipation patterns, investment environment, and coordination mechanism.This article on the whole is according to propose-analysis-problem solving.Analysis of the literature, empirical analysis, comparative analysis, combined with theparticularity of the environmental regulation, then give some suggestions, as to the seadevelopment of the economy and the environment in harmony.
