Genetically Modified Foods (abbreviated below as:GMF) brought by the fast development of biotechnology, The disputes about it has never stopped since it is first put on our human’s dining table in1994. Not only we need to find in our eyes the welfares GMF brought to us but also the unavoidable ethical issues as the potential dangers of it to human body, and the influences it exerts on the declining of the biodiversity, also the patents on life and so on. The purpose of the development of science is the health and happiness welfare of human beings, and being healthy is the very base for exercising other rights. Right to health directly originates from natural law, carries deeply in its natural law a profound moral core, Right to health doesn’t contradict with that it can also be a legal right. Public good and individual good are the ethical reflects of the requirements of right to health in real social life, a perspective in a two dimensional view will help actualization of right to health, though the supreme goal of it seems Utopian and it can never be fully reached, it still can be partially reached, same just as other human rights. There already reached a consensus on the human rights legislation. By the ethical argument for right to health, the solutions for the ethical problems brought by the development of GMF may be found, the relative ethical principles also can be provided for the GMF development to abide by in guaranteeing the implement of right to health.The thesis starts from literature review, mainly introduces the representative research processes and views for right to health at home and abroad. By the present research situation can be concluded that, right to health can be an individual human right and can rise to the legal level hasn’t reached as a consensus yet. The requirements of right to health brought the difficulty in rising to a legal right, this is the hard part of the research here. The two dimensional requirements of the right to health is the new view threshold adopted here. Start ethical arguments for right to health through ethical issues of GMF makes a new research starting point for right to health, national obligations is the base for the realization of the right to health, in order to guarantee that, the development of GMF must abide by certain ethical principles.The1st part of the thesis introduces the reason for choosing this subject, also the purpose and significance and main area and contents of the research. GMF as the application of the trans-genetic technology, it may bring influences for the human body and living conditions also the legal system we have, by the ethical arguments to right to health and combing of its ethical traits, Here offers a new perspective for right to health research through the two dimensional view for GMF’s ethical issues.The2nd part introduces the ethical issues brought by GMF’s development, mainly introduces from three parts:potential dangers for human body health, influences for the declining of the biodiversities and patents on life.The3rd part, carry out the ethical arguments for right to health, analyze the ethical origins of the right to health also its connotations and extensions. The two dimensional requirements of right to health reflects as the public good and individual good two levels. Same as other human rights, it must rely on the state’s legal system then can be finitely and partly realized. Right to health owns the legal right trait, it doesn’t contradict with being also a moral right, since both contains the same ethical core.The4th part, the further realization of right to health under the new history, requires the development of GMF must abide by the moral principles of public’s right to know, harmless, justice and utilitarianism.The5th part, Conclusion.
