Claims of the project is an major part of project management. The construction industry is growingfast, but at the same time, the claims during projects are happening frequently. This is due to the ChineseEngineering Community has weak legal concepts and contract awareness under the constraints of theplanned economic system. How to handle claims during the project, take the claims opportunity to claimand reduce the risk of the contractor becomes more and more importantClaims is a difficult and complex task in China, as it is a weak point compare to other aspects ofconstruction projects. Both consultation and Supervision companies, are lack of claim experience, and donot have the consensus of claims prevention, analysis, and calculation method. Here after is the study doneconcerning above the situation:(1)First of all, analysis of the background of the project claim, combine the status of domestic andinternational engineering and construction industry, describe the basic system of project claim. To increasethe claim success rate by study the description of the claim, the cause of the claim and the claimsprocedures(2)Study of claims which caused by force majeure, concerning the characteristics of the nature offorce majeure, According to the characteristics of force majeure, use the related terms of force majeurelegislation, to standardize contract management, improve the level of project management, request claimwhich due to force majeure, to avoid the economic losses(3)Typical case study of expenses claim and claim for construction time, to verify the claims oftheory and actual use. Discusses the Anhui Chizhou QiuPu garment factory claim cause by both subjectiveand objective factors, which used sub-item method; Anhui Province Shuxiang Mingdi2#commodityresidential buildings, time delay caused by the contractors, owners and force majeure causes. By analysisthe original network plan and affected by various factors affecting the network plan, find out the key linewhich affect the project, then define the detail days of reasonable delay, non forgivable delay, delay withcompensation, and delay without compensation make it as an strong basis for the claim...
