Legal Perspective Study On Small Arms And Light Weapons Control In Central Asia

The aim of this paper was to survey the control of small arms and light weapons in Central Asia from the point of law.With the increase of non-traditional security threats in recent years, the serious unstable factors in Central Asia as well as its surrounding areas arose, which further aggravated the illicit proliferation of small arms and light weapons.Illicit proliferation of weapons directly resulted in the deepening of armed violence, ever-growing regional influence,which led to the tremendous threat to the peace and stability of the nation, region and international community. This violated the theme of "peace and development" in today’s world.Therefore, the control of small arms and light weapons and the research of non-proliferation have a great significance to the overall development and stability, the maintenance of humanitarianism, or the establishment of a harmonious world.This needs to be done at the national. Central Asian and international level.From the point of law, it contains:the law of State, regional treaties, international law and so on. And the most fundamental way to control the Small Arms and Light Weapons is to use legal means. So it is imperative to reinforce legal construction.Enhancing the guiding role of the international community, promoting the inter-regional mutual cooperation and the giving the stronger supervision through the country itself will be a triad of system.To Strengthen the construction of the law, we should, on the one hand understand the principles of the legislation and the relevant principles. An introduction has been given in this paper on the legislature of the Central Asian countries,which elaborates the relationship between the legislation and situation of the country, specific conditions of the Central Asian countries and concludes the effort to participate in the control of small arms and light weapons.On the other hand, we should analyze significant violent incidents occurred in recent years in Central Asia and get to know the characteristics and the way of proliferation of small arms and light weapons in order to find out a more effective solution. The law regulation of small arms and light weapon analyzed in this paper is from the point of supporting system and operating mechanism, combined with the legislative measures in the Central Asian countries. Based in the current difficulties and problems, and we offered constructive suggestions.That is:To strengthen the construction of legislation on domestic arms control, to make good use of the platform of the Shanghai Cooperation Organization, to enhance inter-regional and international exchanges and cooperation, to actively seek international assistance, to curb the spread of small arms and light weapon and push to improve.In conclusion, the proliferation of small arms and light weapons is more of a global problem than a problem of a country or a region.It has a far-reaching impact for China to have a more intensive research on the national security and development strategy. In recent years some research in this area has been taken, but there are few articles, analyzing this phenomenon from legal perspective which increases the difficulty of this study.
