The past three decades, in the health care and social security in China, the hospice care already had relatively obvious development. However, in the field of practice, the hospice care is facing some problems into a number of ethical dilemmas. Hospice care from a religious orientation has the problem of a profound historical origins, the plight of hospice theory from the evolution of the concept of emotional foundation which is unable to the secularization care and humanitarian. Thus, in the modern context, resulting in hospice practice lack of motivation, and fell heavily dependent on medical technology, which is difficult to obtain an effective solution to the issue of euthanasia legislation.First of all, critical to the hospice of the dilemmas as a starting point and ethical reflection. The plight of hospice care is mainly reflected in the practice field, a major performance is that modern sense of the hospice began to enter academia in the research field of vision from the last century80’s, in mainland China, and gradually get the funding of social and charitable force into the practical level. Therefore, some hospitals began to set up a hospice project to set up a hospice research institutions. But so far, three decades later, in additon to a few hospitals in Beijing,Tianjin,shanghai and Guangdong and a small number of hospitals in big cities to carry out the Hospice Services, elsewhere hospice has not yet started, or just getting started. The level of actual medical care is not like the United States and other European countries to be hospice financial support through national legislation and legislation to protect, It is difficult to develop an important aspect of China’s Hospice. However, the fundamental reason is that theoretical research is also in trouble, which the current hospice care is difficult to get development of situation. Therefore, reflection hospice practical difficulties must first clarify the hospice theoretical difficulties,in order to objectively describe hospice practical difficulties.In fact, the plight of the hospice care is caused by the traditional to the modern transition. Gradual rise of the concept of human rights---especially the concept of human rights become a consensus---hospice care as a moral practice to improve people’s quality of life and human dignity,in a sense, its traditional concept has constrained its development.From traditional development, religious people by religious the fraternity emotional and social philanthropy to promote hospice career development. The driving force of these two aspects are crucial, because they constitue the hospice most important emotional foundation. Continue to carry forward the traditional hospice care does not solve the dilemma of hospice. Completely solve the plight of the hospice must imolement the goals of the two theories:the first is to redefine the subject of the hospice should be dying patients,instead of others to take care of the patients;the second is to demonstrate the hospice from dying patients claims rather than from others moral care. Achieve these two objectives in order to find the root cause of the theoretical plight and practical plight for hospice care.Therefore, we reconfirmed the dying as a hospice subject,and to establish its moral status, to order to further demonstrate that hospice is not from the moral consciousness of the moral care. However, death as an organic form of life.the dignity of death is an important part of the right to life,and in order to argue that the hospice care is a right requirement. As a result,the practical way out of the hospice can not be confined to the humanitarian grounds,but through the form of law:on the one hand to promote euthanasia legislation and provide hospice technical legitimacy;on the other hand to promote euthanasia legislative process of the social security system and steady euthanasia as the legal status of the social and public services.On this basis, emphasizing the moral consciousness and religious care, in order to ultimately build a hospice practical way.
