Studies On Movable Property Loan In Old Babylon Period

Due to the lack of primal materials and the hindrance of ancient language, at present, the research on the Old Babylonian loans hasn’t got creationary achievement,there is no domestic scholarly monographs of loans. According to the previsions of the code of Hammurabi, we get a little knowledge of the loans, but we can not get much only according to the code of Hammurabi. The loan contract’s formulary, objects and amounts of the loan, the term of the loan, the loan purposes, the interest rates, the identity of the creditors and the debtors and so on, are not clarity, there are many academic blank. In recent years, numerous scholarly monographs have been publicated by the western schors,such as AUCT Ⅳ,AUCT Ⅴ,EDUBBA7,UCP10etc. These writings give us abundant primal material for researching the loans of Old Babylon period. This dissertation is intent on making primary research on the loans according to the nearly300contracts in these books in order that we can know more things about the private ecnomic and commercial activities, the economice state, the produce relations, the class relations, the nature of Old Babylon society and so on.This dissertation contains four chapters besides the introduction and conclusion. The introduction involves the reviews the status of major research, the reason for this dissertation topic. Also introduced the selected topic basis, research methods and research focus of difficulty.Chapter1:detailed analysis of the loan contract and receipt’s formulary, and the contract terms of verbs in the simple analysis.Chapter2:specific analysis of the objects and amounts of the loan, the term of the loan and the loan purposes.Chapter3:detailed analysis of the interest rates of the contracts. In addition to the code of Hammurabi’s fixed interest rates, there are a variety of different loan interest rates. Chapter4:the identity of the creditors and debtors, the identity of the witnesses are analyzed.In the conclusion part, the author makes some conclusions according to the analysis of the movable property loan contracts.
