Analysis Based On Crime Scene Investigation In Public Security Organs

With the advance of China’s socialist legal system, the handling of criminal cases is becoming more and more strict and standardized. The scene investigation in criminal cases is the most important part of investigating and solving cases. The role and significance of evidence acquired in the crime scene investigation, which considered as objective evidence, is far greater than the suspect’s statements and other documentary evidence in the current proceedings. However, due to the effects of inquisitorial system model in the criminal proceedings, the traditional views, such as "Emphasis on physical, not proceedings," "Emphasis on cracking, not protection"," Emphasis on powers, not right", have not been fundamentally improved. In practice, illegal evidences, especially the torture still repeated. Although the law has prohibited, some investigators still defy the law. Therefore, the legality that obtaining means and process of evidence in Crime scene investigation, not only affect the success of detection, but also related to the prosecution of the case can proceed smoothly.At present, China is in the period that contradictions among the people emerge, crime frequency, complicated struggle against the enemy. The public security task which fight to crime, protecting the people and maintaining social stability is difficult. At the same time, the socialist legal system improved continuously, the community supervision enforcement of law activities continue to increase. Under this background, it’s more and more important for the public security organs to carry out on-site inspection work, and the requirements of on-site inspection became higher. It is a big and urgent issue, that how to guarantee the successful completion of on-site inspection tasks and how to improve the ability or level of on-site inspection work, for Grass-roots public security organs at all levels. Based on the above analysis, this paper started from the following part of the discussion.In the introduction part, the paper included the Problem, literature review, study the meaning and purpose, paper ideas, innovation and the lack of paper and so on.In the second part, it describes the scene and the criminal scene investigation the basic theory. First, the basic definition of criminal scene and its associated specific elaborated further on-site inspection for the content of interpretation.In the third part, the primary problems exist in the criminal scene investigation in China was proposed. This chapter focused on the inadequate of inspection techniques, inadequate command on the site, unprofessional site protection and witness issue nonstandard.In the fourth part, it introduced the development and setting of crime scene investigation in the United States, Canada, Japan and other countries. From the comparison of the developing country, the shortage was found and the improvement direction of in our current system that-spot improvement of the system under the direction of crime scene investigation in our current system was proposed.The fifth part, improvement solutions have been proposed. This chapter focused on the current system of on-site inspection issues existing in our country, and proposed compatible enhancement solutions.
