Crime scene investigation is an indispensable part of the work, which will have a direct impact on the success of the criminal investigation. As China's technological progress and changes in social situation, scene investigation work is facing unprecedented challenges. The standardization of the crime scene investigation is the trend of the countries ruled by law. At present, China's scene investigation is still at a low level, infrastructure lag, the legal system is not complete, evidence management loosely, even the existence of illegal, and even the phenomenon of violations of civil rights and interests. Therefore, promoting the standardization of the crime scene investigation is necessary. This paper discusses the concept of the scene investigation, the current theories and practice problems, and analysis the basic theory, which is necessary of the scene, and discusses the conflicting values in the scene investigation, and then puts forward some measures of the standardization of the crime scene investigation.The author organizes the paper in accordance with proposing, analyzing and solving the problems. In addition to the introduction and conclusion, this paper is more than thirty thousand words, and is divided into four parts.In the first part, the author proposes the problems of crime scene investigation, including the concept, the status and so on.Firstly, the author proposes the concept of the crime scene investigation. The main concepts related are not different from others very much. The author defines it from the legal documents starting of the Ministry of Public SecuritySecondly, the author analyzes the current limit of the crime scene investigation, which mainly in the view of theoretical, systematic and practical of law. The academic have conducted systematic study of the crime scene investigation, and much useful explore, especially have applied the interdisciplinary field theory to the research, which has very important significance. At the institutional level, especially there are deficiencies in legislation and evidence management system ,which needs further improvement. In addition, there are also many problems in the practice, such as the lagged technology and non-standard measures, and so on.In the second part, the author proposes the basic theories of the standardization of the criminal scene, including the theory of the detection of management, the systems and the scientific investigation. The basic theory of management came from the theory of the modern management, and it combines the principle of modern management and investigation practice, and then proposes the principles and measures of management, which adapts to the characteristics of modern management.The basic idea of system theory is to put the objects studied and handled as a system, to analyze the structure and function of the system, and to study the relationship between the system, the elements, and environment and the regularity of the changes between them. In addition,the system theory make the view with the optimization of the system. As a system, the crime scene investigation also has the basic rules and characteristics of the system. So the system can be applied in the field of the standardization of the crime scene investigation.Scientific investigation means applying the knowledge, methods and technology which is caused by the development of science and technology to the criminal investigation. Crime scene investigation is the work conducted on the physical evidence as the center-site. Investigation is a traditional method, in addition to which, many other measures that can used in the crime scene investigation are method with scientific and technological. Crime scene investigation needs to integrate the use of a variety of scientific and technical means to detect, collect and storage the evidence, which is the most concentrated expression of scientific investigation.In the third part, the author proposes conflicting values in the standardization of crime scene investigation, including the principles of efficiency and procedures, punishing crime and protecting human rights, and the secret investigation and the right to know.The author first analyzes the relationship between the principle of efficiency and procedures, which should be obeyed both in the scientific investigation. Secondly, there are also conflicts between the principle of punishing crime and protecting human rights. Detecting the crime is the main purpose of the work. However, we must follow the relevant legal rules, not to on the expense of the violations of human rights. Finally, dealing with the relationship between the media and the investigating agency is also a very important work, which mainly involves the right to know. So we should find a balance between the principle of secret investigation and the right to know.In the fourth part, the author discusses is the measures of standardization of crime scene investigation, including site survey the legislation and standardization of management. The author first analyzes the legal should how to deal with the relationship between the flexible and the mandatory. The author thinks that we should make the provisions into details, and establish the standard operating procedures. Standard Operating Procedure (referred to as SOP) is the method of improving the efficiency of crime scene investigation, which is respected by the international police. Because it can provide a concise and easy step to prevent bias and omission. The author analyzes some standard operating procedures of the United States and Taiwan police s and proposes some measures to improve the work of crime scene investigation, hoping they are useful to improve the level of crime scene investigation of the public security organs in China. The management of crime scene investigation can be improved and designed in the follow way: the criminal scene, person, evidence and logistics.
