On Duty Crimes Investigation And The Human Rights Protection

Today when human rights have been paid close attention and democratization process has been speed up, to discuss protection of the rights of criminal suspects’has an important theoretical and practical significance for building a scientific structure of litigation to advance justified proceedings, and thus achieving the legalization of criminal procedure.How to coordinate the relationship between the fight against duty crime and protection of human rights to achieve the purpose of both ensuring the smooth implementation of the precuratorial power of investigation and protecting the legitimate rights and interests of criminal suspects’is a realistic problem which legal construction and human rights protection have faced. In order to better study the protection of human rights of criminal suspects’during process of investigating duty crime, first of all, this paper generally analyzed the basic theory of detection of crime on duty, gave a brief description of the concept and characteristics ofdetection of crime on duty; then it discussed the basic theory of protection of human rights, the focus was to clarify the protection of suspects’human rights in career crime investigationChapter II of the paper focused on discussing the relationship between career crime investigation and protection of human rights and its theoretical basis, it aimed at clarifying the protection of suspects’ human rights in career crime investigation.Chapter III pointed out the status and thinking of protection of human rights in career crime investigation to arouse readers’attention on the issue that the paper discussed. In order to prevent abuse ofduty crime detection power, we should focus on protection of individual human rights to clearly define suspects’basic human rights and related rights.In the last chapter of the paper, the author attempted to propose a mechanism to solve the problem, such as establishing a correct guiding ideology in investigation, changing mode of career crime investigation and strengthening supervision, establishing presumption of innocence, building up counsel system, perfect reticence right system and so on.In this paper, it provided a superficial exposition on the protection of suspects’human rights in the process of career crime investigation, it hoped to achieve the purpose of providing more practical guidance in future study.
