The Game Equilibrium Research Of Information Resource Copyright

The research on information resource copyright from the perspective of legal is much more than the perspective of game theory both at home and abroad now. This dissertation will use the basic principles of game theory to make some analysis about the interest balance of information resource copyright, and to supply some new perspectives to the research of some relative fields.This dissertation is based on Literature research, mainly using the methods of Qualitative research and inference deductive, which builds up a basic Principal-Agent gaming model to do some gaming analysis among the interest groups of information resource copyright and finally get the Nash equilibrium solution. Besides, the dissertation also makes a summary about the present copyright systems of Domestic and international. Based on these research and analysis, this dissertation mainly obtains the following conclusions and recommendations.Firstly, the relationship between copyright protection and information resource sharing is unity of opposites, the two have some conflicts themselves, but their essential purposes are the same, which is promoting the effective and reasonable using of information resource as well as the healthy development of the whole information resource industry.Secondly, the development of digital technology has both advantages and disadvantages. On the one hand, it provides the copyright with very strong technological protection measures, on the other it makes information resource works spread without tangible medium, which brings about the result that traditional copyright laws have lost the basic premise of information resource protection. So, this dissertation puts forward that it should balance the influence of technological measures on copyright protection and keep the realization of public interest away from the technological protection of the works too excessively.Thirdly, there has derived many new right contents of copyright under the internet environment, which brings out much difficulty to judge the work type and copyright protection standard for the traditional copyright laws. Therefore, this research directly raise the view that we should complete the systems and norms related to copyright protection so as to make up the disadvantages of the current copyright system on the basis of interest balance.Lastly, the copyright owner’s right protection wish is influenced directly by the degree of difficulty of infringement judgment, right protection process and some other factors. For this point, this dissertation brings forward that we should complete the copyright information management system, strengthen the construction of database of information resource copyright, so as to provide information guidance and data support for the supervision of information resource copyright protection and the trial of copyright dispute cases.
