Justice is the most important themes in human political and social life. The theory of justice of liberalism have been guiding the main stream in political philosophy category for several centuries, though there are many defects in it. which shouldn’t be ignored. So it’s becoming increasingly necessary for us to review and reanalyze theory of Marxist justice in modern times.When we discuss theory of Marxist justice, the first challenge is that whether the theory of Marxist justice exist or not. The Tucker-Wood Thesis expressed the view that criticism of capitalist society of Marx is not based on justice; capitalist exploitation is just; and a communist society is that society which beyond just. Husami don’t agree with this view. From the dispute between Wood and Husami, we could conclude that both of their argument have a reasonable point, but also are not comprehensive. Marx always made use of justice in two ways, the broad area and narrow area, Wood adheres to the former, and Husami insist on the latter, The theory of Marxist justice is not prior.The theory of Marxist justice experienced a "ruptured" phase. The early Marx insist on the liberal tradition which put emphasis on abstract principles of liberty, equality and rights of liberalism and which was inherited from of Locke, Kant, and others, then Marx gradually saw the limitations of justice of liberalism from analysis of "alienation", he gradually turn his steps towards critical justice of historical materialism. At this time, Marx saw the social production is the real foundation and motivation of the society; Justice is the product of social production and belong to a historical category. The development of material production determines the evolution of the content of the justice. Production, not justice, dominate distribution.That the theory of Marxist justice and "justice as fairness" of Rawls is similar to some content. Both of them intend to provide support for the people in bottom of society and for vulnerable groups. But the difference is obvious:Justice as fairness derives from the original position, reach the two principles of justice by a series of restrictions eventually. Marx’s theory of justice is from class theory and conception of alienation. They are not consistent in the definition of the freedom, Marx’s theory of justice mainly expressed as the positive liberty of political philosophy characteristic, but also contained the content of the negative aspects, and "justice as fairness" is typical of the negative liberty, but also show the color of positive liberty, when referring to Whether communism would come true, Marx and Rawls had different interpretations.The value of theory of Marxist justice makes it extraordinarily eye-catching brilliance in the contemporary china. The development of contemporary socialism with Chinese characteristics should actively explore the resources of theory of Marx’s justice, and critically learn from western theory of liberal justice, whose further purpose is to perfect the market economy with Chinese characteristics, and to provide theoretical support for building a harmonious society of socialism with Chinese characteristics.
