Civil Servants At The Grass-roots Level Ethical Thinking In The Process Of Law Enforcement

Located in the bottom of multilayer administrative structure, the basic administrative level, carrying the missions from the upper administrative level and the appeals of this people, is the immediate government for the mass to make their voice heard. The law enforcement of the basic administrative level is a crucial guard for the implementation of national policies to ensure the social harmony and stability. Under the guidance of Marxism and Essentials of Mao Zedong Thought, the law enforcement of basic administrative level has been following socialist values and moral norms and exerted great impact. The law enforcement of basic administrative level is inclusive, tedious and troublesome. In order to secure civil rights, the law enforcement officers work hard day and night to ensure a neat townscape and civilized neighborhood.However, we are imposed to a number of law-enforcement problems which result in negative opinions on the law-enforcement officers. A detailed analysis has been carried out to explore the reasons why law-enforcement officers, as the guards of civil rights, have gained aversion from people. The problems arisen in law-enforcement processes are always characterized with violence, which have posed a gap between the two parts and added confliction. The main problems of former law-enforcement lie in frigid enforcement which neglects people’s psychological appeals. Considering this aspect, the author, who has been working in the basic administrative level for many years, first analyses the basic conditions of officers of this level (e.g. age. educational background, work duration) Second, the author categorizes and analyses three kinds of moral dilemmas resulting in disharmony---power vacuum dilemma, moral value dilemma and human elements dilemma. Last, the author puts forward the concept of "moral considerations in law enforcement", by analyzing the similar cases in the basic administrative level and the necessity to carry it out. to propose three approaches (administrative departments, law enforcement officers, and people to be instructed) for moral consideration.The author holds that due concession should be made between "law" and "human feelings" and more cares and considerations on moral values. Being the lubricant for law enforcement of basic administrative level, these cares and considerations would foster a wholesome township and accelerate the construction of harmonious socialist society.
