Research On Administrative Law Enforcement Under Moral

With the development of economy, China is experiencing a period of great social reforming. This social changing process is a process of modernization. In modern society, public administration is a key to people’s harmony life. Administrative enforcement is the the performance of public power and the core of public administration, which has to be guided by public interest. When fulfill its public duty, the administrative enforcement has to follow the nature and rule of public affairs. Studying the moral disorder problem in administrative enforcement is benefit for the public administration’s healthy and efficient development, which has the equal importance for people’s happiness.There are mainly five reasons for the moral disorder problem in our administrative enforcement:Firstly, the subject of law enforcement lost the direction when facing the choice of public interest and personal interest; secondly, there is a lack of equality between the subject of law enforcement and the administrative counterpart; thirdly, there is a lack of justice because of the invalid control of public power; fourthly, there is a lack of credibility due to the behaviors of breaching promises of the subject of law enforcement; fifthly, there is a lack of responsibility on account of the irresponsible subject of law enforcement evade the consequences.Aim at the present moral disorder problem in our country, there are four dimensions for the counterplan:firstly, thought decides the action, there should be a morality-oriented culture in the public administrative department; secondly, idea decides the behavior, there should be a moral guidance for the subject of law enforcement; thirdly, behavior decides the result, the administrative enforcement of law should be adjusted and improved by morality; lastly, system decides the effect, there should be a moral regulation in the administrative enforcement of law to ensure the effectiveness.
