Based on either the perspective of social practice or that of the theory development of administration, the significance of ethical selection of administrative acts turns to be a crucial theme of the contemporary research on public administrative acts. The basic research of ethical problems from those acts is closely related to the feature of "metaphysics" of this discipline. It intensifies the prolonged ethical problems of those acts due to the diversification of the modern society. Thus,study related to ethical problems of administrative acts conducted in this paper titled with "Ethnical Dilemma of Administrative Acts Selection and Its Solutions" is noteworthy:they facilitate the social value of administrative acts, the philosophical of morality of administrative acts and the construction of the system of administrative ethics with Chinese characteristics.This paper summarizes the present situation and main features of administrative ethics of China’s civil servants based on general logic induction and deduction from related perceptual facts of administrative experience and ethical relations, and deprives problems those civil servants will face concerning ethical selection. Among those problems the most noteworthy one is general realistic predicaments such as the liberty and restriction for the subject, the community and individual for the object, the form and content of procedures together with ideal and reality in regard of the environment. The conflicts and problems may be challenging for values like autonomy, usefulness and fairness. When it comes to discover proper ethical principles to waive them and then find the idea and solution to ethical problems civil servants’behavioral selection, this paper believes that under the theoretical support from dialectical and practical rationality, it is possible to completely solve these problems. In details, adopting practical moral rationality to improve moral selection of the administrative body, to improve the realization system of ethical selection via practical legal rationality and to rationally build service system of public government through practical public rationality. When administrators are confronting with ethical selection of administrative acts, with all measured above it is possible to reflect both subjectivity features and moral dominance led by the optimization of selection. Therefore, this paper is trying to figure out multiple new ideas, visions and solutions regarding various ethical and moral problems for civil servants at present in China.This paper is divided into four chapters. In the Introduction, the author introduces the background of topic selection, the researched theories and practical significance. Furthermore, the author describes theoretical research situations of this topic domestically and internationally, which defines the fundamental idea and overall framework of this paper together with an outline of the methodology, research emphasis and innovation. Chapter Two offers definitions of major concepts, such as behavioral acts, selection of behavioral acts and ethical selection of behavioral acts, and explains ethical dimensions (including autonomy, usefulness and fairness) of selection of administrative acts from the perspective of being dialectical, rational and practical. Chapter Three emphasizes on general ethical problems of the selection of administrative acts, encompassing the liberty and restriction for the subject, the community and individual for the object, the form and content of procedures together with ideal and reality in regard of the environment which cause ethical problems. In the view of Karl Marx’s practical philosophy, only with the historical combination of the property of fact of dialectical and practical thinking, and the quality of value, can problems be well resolved. Chapter Four puts forward specific, practical and dialectical approaches for avoiding ethical problems of administrative acts’ selection via exploring the mentioned concepts and discussion of ethical problems of selection, i.e. improving moral selection of the administrative body via practical moral rationality to gain liberty in restriction; improving administrative ethical selection’s realization system to present morality in lawful ruling via practical lawful rationality; paving way for fairness against the reality restriction via building public government’s service system based on practical public rationality.
