Film Classification Of Legal Research Management System With Chinese Characteristics

American jurist Holmes once said:"The purpose of legal study is to get a forecast."This paper is intended to build the film rating system on the base of theory and practicalconditions with Chinese characteristics.The overall structure of this paper：the first part，the theoretical basis of Chinese filmclassification management system are described，including the concept of film ratingsystem is determined as well as the significance, and the theory of rights conflict withbalance which balances the tripartite rights of the individual, cultural security andindustrial development on the conditions that making the rights of adults and industrythe smallest impact limit; the second part, realities of the system are described，including the feasibility of the system combined with the history and current situation ofChina’s film rating system. From the view of historical, the Chinese have practiced thefilm rating system in the late-1980s; from the view of now, the highlight of thedrawbacks of the film review、the demands of film industry，more importantly, theexisting conditions are suitable to the film system; the third part, the film rating systemwhich includes legislative, judicial, law enforcement and auxiliary systems whichinclude the way of management, the strengthening of national education, governmentpolicy shift, the protection of local film with consideration with excellent experience offoreign film rating system are determined.Innovation includes: First, the theory of rights conflict with balance is used in theconstruction of the film rating system for the first time, with the rights for film; second,rational analysis on the historical reasons for failure of the film rating system and thefeasibility of the system, so as to discovery the obstacles and deal with the barriers ofthe classification system; third, a common standard of foreign film rating is summarizedas "one center, four basic points"; at last，to build a law-based, supplemented withSelf-discipline film rating system with Chinese characteristics which is reflected in:First, the judiciary, making film reviewing court, the first trial is led by the judge andthe second by the chosen people and guided case; second, the legislation，the filmproducts is not equal to the movie audio and video products through determiningwhether it is controlled; third, take full advantage of China’s mature identity card systemto divide the viewing audience groups.
