Research On Chinese Film Examination Mode From The Perspective Of Administrative Law

Our Film Censorship has been mainly taking the way of administrative licensing, which is throughout the movie screenplay, production, content and all the processes of transmission. Essentially,this system is an intervention that the public authority pressed on the media,which is related to the administrative subject, the relative benefits administration and different subjects between the measure of the third person. The current system of film censorship is has been criticized for suffering due to the presence of the excessive administrative intervention, impede freedom of creation and the healthy development of the film industry;with the trend of film development become more open,the conflict between films and the Chinese system of film censorship become more intensified,that is why topics about whether the film censorship should be keeping,whether the system of film classification should be introduced or not has been always the focus of attention.At present, research on film censorship are mostly framework and indirect appeal,the study for how to build a suitable system of film censorship for China,how to make up for gaps in the relevant laws, the issue of establishing the system of research supporting is not deep enough,and also with less concrete recommendations.As for related discusses about how to achieve a balance between the interests of the principal, how to protect the legal and balanced development of the film on the development of such issues is scarce,therefore,this paper attempts to solve the above problems to make a breakthrough,which is also the core value in this study.Accordingly, this article mainly from the perspective of administrative law cut of the film censorship this cross-disciplinary analysis of the problem. First,the concept of the movie and the movie review to sort out, the systemicallydemonstrates our existing system of film censorship, especially for administrative counterpart and the third party’s rights restrictions; secondly, in comparison to the extraterritorial application of the classification system basic rationality and feasibility of the introduction of the existence of the analysis, drawing on the hierarchy theory measurable benefits, measured between the public power and private rights,the rights of producers and audiences,and also audiences of different ages,focus on the pros and cons to consider the merits of the review,which is not only the emphasis of research articles, but also its core value; Finally,the article attempts to locate and solve the optimal balance conflicting interests:the future system of film censorship should be within the framework of a licensing system the introduction of the grading system, the ideal model is based on the age of the audience for the film is divided into five criteria, while establishing that matches cinema system, complete set of supervision system,eventually forming a complete set of line with China’s national conditions, in order to examine the basis of feature film management system system.
