As the development of socialist market economy, the labor relations have changed fromthe stage of individual to the phase of collective, and the adjusting of collective labor relationshas become a prominent research subject. Through the consultment with employees andemployers or their organizations, collective negotiation system is used to adjust the system ofcollective labor relations, and it is considered to be a great "social invention". What’s more, ithas been proved to be one of the most effective mechanism to reslove labor disputes, promoteharmonious labor relations. The promulgation and implementation of the "PRC LaborContract Law"made the individual labor relations in China are well adjusted and standardized.Concerning about the adjustment of collective labor relations and the core system-collectivenegotiation system, will be the development direction of China’s labor legislation.Firstly, clarify the relevant concepts of the collective negotiation system, describe thetheoretical basis, on the basis of this, analysis the necessity of the collective negotiationsystem. In the second part of the paper,introduce the representative of foreign collectivenegotiation system to derive inspiration for complete the collective negotiation system.Finally, a detailed discussion to china’s collective negotiation system including the situation,problems and improving policies will be given.
