Research On Nomocracy Of Food Safety Supervision

The food is a necessity of human existence, food safety is directly related to humanhealth and development, it is also related to human civilization and progress. In recentyears, a series of food safety incidents, such as Sudan red, melamine, waste oil,contaminated milk, and other unexpected outbreaks of human civilization produced asignificant impact wake of the global concern about food safety issues. How to reshapea healthy, safe and environmentally friendly food consumption environment, andcomprehensive supervision on food safety has become the hot topic around the world.In this article, starting from the perspective of administrative law, analysis ofexisting food safety regulatory laws, regulations, and analysis since the implementationof the Food Security Act of2009, China’s food safety regulatory status quo and existingproblems. By borrowing from the more advanced and comprehensive food safetyregulatory experience, to put forward countermeasures and suggestions for China’s foodsafety regulatory nomocracy.The existing food safety regulatory laws of China is not perfect. The food safetylegislation has the bad interests tendency. The legislation method is not science. Thesegmentation regulatory model may lead to the regulatory blank or regulatory functionscross. There are contradictions between the segmentation regulation and the varietyregulation. The basis of the food safety law enforcement is not clear. The enforcementdepartments are not coordinated. The force of enforcement departments is not enough.The function of social organization on food safety supervision is not into full play. Toachieve our country’s food safety supervision of the rule of law, it should first improvethe legal system of food safety regulatory. Secondly, build on the basis of theadministrative organization of the new food safety supervision system, innovation, foodsafety regulation and law enforcement mode, while exploiting the non-governmentalorganizations in the food safety role in the regulatory process so as to really implementthe rule of law in the food safety supervision.
