Study On Legal Issues Of Chinese Government Procurements

Government procurements is an important means for countries to meet the publicdemands and it has a positive meaning for saving the country’s financial capital, enhancingthe awareness of market competition, optimizing the structure of the domestic economy, andpromoting the rational allocation of resources. The primary governments’ procurement is animportant part of Chinese government procurement and is the cornerstone of the overallrunning of supporting Chinese government procurement. After ten years of development, theprimary government procurement system in our country has gone through from scratch, andmany primary government procurement management agencies has improved the transition ofself-innovation in the system design according to the local situation at that time, whichchanged the old practices of copying of the old situation. The primary governmentprocurement system has become the defender for implementing primary governmentprocurement legitimately and reasonably, and the builders of the network of Chinese overallgovernment procurement system, which painted brilliant chapter of history in thedevelopment of Chinese government procurement system. We should not only see the resultsbut also be concerned about the need to solve the outstanding problems existing in theprimary government procurement in order to break the existing limitations of the overalldevelopment of China’s government procurement, and try to enhance the driving force. Someproblems have become stumbling block of restricting China’s primary governmentprocurement to achieve greater development, such as unscientifically setting of agencies,confusion of responsibilities of representative agencies, disorderly management of funds andaccount and the lower quality and efficiency of staff of government procurement and using offunds. In order to keep a healthily and orderly operation of the primary governmentprocurement, and an overall good situation of State government procurement, those problemsmentioned above must be analyzed one by one on these issues to resolve.The author based on the above considerations and put forwards some ideas includingimproving supervision over government procurement system; reinforcing the internal and external oversight power; clarifying responsibilities between governments and agencies;drawing a distinct boundary of the rights for agent authority of government procurementagencies; establishing a government procurement agency reward and punishment mechanism,and urging them to fulfill their duties; strengthening government procurement fundsmanagement system, and truncating in the chain of funds that is unreasonable, inappropriategovernment procurement behavior may occur; improving the professional quality ofgovernment procurement staff and strictly controlling the selection, training, assessment.
