Study On American Government Procurement Legal System Under WTO Government Procurement Agreement Background

To promote the trade liberalization of government procurement,every nation in the world are focusing how to delete trade barriers in government procurement area and trying their best to open the international government procurement market.In consequence,the great potential of this kind of market could be explored.In this trend,government procurement system has played an important role.The development of government procurement market needs advanced and comprehensive system as support.This dissertation studies American government procurement system under WTO government procurement agreement background to give China some thoughts and suggestion during the negotiation to enter into GPA.The first part of this dissertation is introduction,started with the background and significance of choosing the topic.Then,the dissertation discusses about the domestic and international research situation and results about government procurement system,WTO GPA and American government procurement system,emphasizing that the creative viewpoint of this dissertation is combining GPA and American government procurement system.Also,the adopted study methods have been mentioned in this part.The second part of this dissertation commences with the basic theory about government procurement and its system,which elaborates the concepts and functions of government procurement,such as promoting the economic development and execute public policy,as guidance of the study of this topic.The following is to explore the need and cause of government procurement system from institutional economics and government intervention theory.From then on,the dissertation analyzes the internationalized development of modern government procurement system and clears the definition and representation of which.Furthermore,this dissertation reviews GPA through studying the background,the significance,the particularity as plurilateral agreement,general principles and contents of GPA and its impact on China as a base for the later studyThe third part of this dissertation analyzes American government procurement system under WTO GPA background.This part emphasized the close relationship between GPA and American government procurement system,which includes the obligations and commitments for the United States made in GPA,the domestic law adjustment after entering into GPA and whether or not ARRA and execution order conform to GPA.Furthermore,this dissertation studies the free trade agreements with government procurement chapter which signed by the United States and other countries under GPA background compared with GPA,and figure out the influence of GPA on them.The fourth part of this dissertation elaborates the inspiration for China to deal with government procurement from studying American government procurement system under WTO GPA background.In details,the dissertation analyzes whether or not China should enter into GPA and how to handle the negotiation and the huge impact after join GPA.This part also mentions how to complete the own system about China government procurement to promote the progress and development of China on government procurement field.
