Education Consumer Rights Protection Law Research

With the need of society and personal development, education expenditure is playing adominant part in household consumption. However, the rights of the educated are repeatedlyinfringed and lack powerful protection. Therefore, there is necessity to set up a complete andsound system for the educated. Through analysis and research of legal problems of educationexpenditure, combining the present situation and causes of the infringement of their rights, thesuggestion is put forward that education expenditure should be included in ConsumerProtection Law and the pretective system should be set up in legislation,administration andjudicature. This is not only able to keep the educated protected, but also advance the setup andperfection of relative system and policy, which will in turn draw attention to the protection ofthe rights of the educated, and it is of great significance to harmonious education expenditureand the development of national education career.The essay is divided into three parts.Chapter one focuses on legal problems of education expenditure, in legal nature andlegal value. First, the argument focuses on the roles of the educated and education institutionsoperators, and the basic research is carried out in terms of the idea that education expendituregoes for Consumer Protection Law. Besides, beginning with the legal value of freedom, orderand profit, the value and significance of the idea that education expenditure goes forConsumer Protection Law is discussed. Through the research, the theoretical issues ofapplicable law are solved and it lays the foundation and guarantee for later research.Chapter two focuses on the present situation and legal causes of education consumers’refringement. First, the research is carried out in terms of the present situation of rightsinfringement, which includes poor education quality, arbitrary charges for tuition, falseadvertisements,etc. Second, further analysis is made in terms of the causes of infringement,which include the absence of lagal protection, imperfect administrative supervision,inconvenient Judicial relief channel, unsound social protective system, consumers’ weakawareness of rights protection, etc. Chapter three focuses on the protection approaches to educational consumption rights. Inthe areas of legislation,administration, judicature, society and consumers self-protection,solutions are put forward to perfect Consumer Protection Law, to set up Comprehensive andmulti—level protective system, which will take effect of particular law and truly fulfill theprotection of education consumers’ rights. This chapter is the final achievement of puttinglegal theoretic research into practice.
