Equal employment right is an very important part of femine right,but also is theimportant insurance for the female employee that coming out of their families,takingpart in the society. In order to reducing and resolving the special difficulties of femaleemployee duing to the physicological characticds,the chinese government has alwaysbeen enacted a series of public policies,such as Provisions on Labor Protection ofFemale Employee,Provisons on the Scope of the Taboo Labor of FemaleEmployee.But a part of these contents has not meet the need of the sitution,and doneimplicated infringement on femine right.More and more people question theProtective effect and the constitutionality of the taboo labor of female employee.TheState Concucil has decided to revised the Provisions on Labor Protection of FemaleEmployee,so reflections on the taboo labor of female employee under the constiutonare advantageous to petect the legal systen healthiness.The paper is divided into three parts to analyze the he Taboo Labor of FemaleEmployee under the Constitution.Chaper one focuses on the statuory stand-point andthe original intent of legislation. Chaper two focuses on analyzing the appliction ofmodeles constitutional test standard of the taboo labor of female employee. Chaperthree focuses on the enlightenments of the trend of international legislation about hetaboo labor of female employee at present. The last the author will dicuss thelegislative proposals about the special labor protection of female employees. |
