Legal Issues And Countermeasures Of PSPC Rules Under Chinese Law

The Maritime Safety Committee of the International MaritimeOrganization enacted the Performance Standard of Protective Coatings(PSPC) rules on December8,2006, which become the binding ruleswithin the international convention of SOLAS. It is known that PSPCrules will come into force on July1,2012. With the time approaching,Chinese shipyards shall make full preparations for the challenges.Regarding that, the paper will give a brief introduction of thedefinition of PSPC first, especially the legal procedure of IMO1247, andthe legal conflicts under Chinese law and English law. The paper willcontinue to analyze the situations of “unforeseen circumstances” by thecontrast of English law and Chinese law. The paper will also discuss thelegal issues and the remedies in the event of shortage of final installment.In the end, the paper will analyze the solutions under the circumstances ofship registered by shipyards.
