During the Eleventh Five-Year Plan of China’s development, energyshortages meant brownouts had to be introduced in many regions across thecountry in order to realize the energy saving target. Some people think thatthe Government’s energy saving is conducive to scientific development.Power limitation is understandable because of the stage of short-termemission reduction targets. However others have had the view thatrestriction of the electricity supply at the expense of people’s livelihooddeviated from the core purpose of energy saving and the requirements of theconcept of scientific development. Therefore, it is necessary to start at thelevel of analysis of the legal system.In this paper, the method of empirical analysis is used. By examining theentire process of events to limit power supply in Jiangsu Province, theauthors analyze the problem of the legal system in the event. Furthermore,the author assesses the root causes of the phenomenon of limiting powersupply to electricity enterprises in China. In the legal perspective, the author analyzes the realistic contradiction of our energy reduction policies. Thepaper is divided into five parts.Part I: Empirical analysis is used to analyze the background of an energysaving emergency. The author sumed up the root and control measurs of theenergy saving emergency of Jiangsu Province. The author also selected100industry factories to carry on the questionnaire of investigation to assess thesocial effect of the energy saving emergency.PartⅡ: I analysed the hierarchy problem and point out the problem withthe energy saving index are lack of scientific principles and planning.Limiting power supply in electricity is contrary to the purpose of energysaving and consumption reducing.Part Ⅲ: The author analysed the emergency control measures aboutlegitimacy and rationality, and pointed out the lack of legal basis. Whatcaused the loss of economic and social is too large. So it was obviouslyunreasonable.Part Ⅳ: Britain and Japan experience in the advanced system of buildingenergy saving system to be analyzed to draw our energy reduction that canlearn from, which is used to build support for the work of an energy savingsystem. By employing the scientific development concept, the authorpresents the legal system to solve the problem of energy saving in the event, which is to limit power supply. These include the following: the systemspecification process of setting goals should be sound, and the emissionreduction target should be scientifically formulated. A market mechanism thatwill help the system should be established. Public participation in the energysaving system should be established and the details of specificimplementation need further improvement.
