Management Legal System Under Emergency Environmental Accidents Mechanism Research

Sudden environmental incidents are the public security environment events happened suddenly that caused or may cause heavy casualties, property losses and the major national or a region’s economic and social stability, political stability and pose a major threat and damage and have a significant social impact. Response to environmental emergencies, people need to handle emergencies in the legal system, and gradually realize the rule of law process. After the founding of new China, as environmental issues become increasingly prominent, high-tech pollution, electromagnetic pollution, chemical pollution, nuclear radiation, earthquakes, tsunamis, etc., may lead to social and public security crisis in a certain range.Multiple environmental emergencies have brought great harm to the production of people, life and safety. Especially at present our country is in the important period of social transition and the social contradiction multiple background, environmental emergencies disposal effect is good or bad, to a certain extent affected the people to the party and the government and the centripetal force of satisfaction, affected social sustainability, also has of great significance to construct the socialism harmonious society.Entered twenty-first Century, especially in 2003 as" SARS", the Party Central Committee, the State Council hitherto unknown to emergency mechanism construction in an important position, has promulgated a series of laws, regulations and emergency plan. But from in recent years, our country in dealing with such as earthquake, snow disaster and environmental emergency practice looks, our country in the construction of emergency mechanism and management still exist many problems and loopholes. The United States, Japan, Russia and other countries have formed a relatively complete legal system and effective emergency mechanism. Therefore, we can make full use of the advanced experience of foreign countries, accelerate our country environmental emergency legal mechanism construction.This paper from the unexpected environmental event concept, discusses the characteristics of environmental emergencies, emergency mechanism of connotation and the necessity of establishment. Secondly, the article discussed our country environmental emergency management legal system’s present situation and the existence question, in drawing lessons from the country such as the United States, Japan, Russia emergency environmental law on the basis of the mechanism, put forward to perfect our country environmental emergency management legal system countermeasure and proposal.
