China’s Community Correction System Case Analysis

Our country does not have those various types of community correction law, buta similar foreign application of community corrections has detailed provisions incriminal law, criminal procedure law and the prison law . In addition, our countrystill has the Chinese characteristic non imprisonment punishment of control incommunity sentences, as well as with the personality of the deprivation of politicalrights and temporary execution outside prison system. Since 2002 China began inBeijing, Shanghai and other places for the community correction, communitycorrection work legal system construction has received extensive attention. In July10, 2003, the Supreme People’s Court, the Supreme People’s Procuratorate, theMinistry of Public Security and the Ministry of Justice jointly issued on theCommunity Correctional Work Notice; In May 9, 2004, the Department of Justiceissued the Judicial Administrative Organ Body Correction Procedures; May 1, 2011PRC Criminal Law Amendment ( Eight ) had been promulgated, making moreprovisions of community correction system.This paper, from China’s early history of the community correction as a startingpoint, studies the contemporary community correction system, and presents a lot onChina’s community correction system. It focus on the Helping district of Shenyangcity as a key research area, presenting community correction system implementationstatus and illustrating the effect investigated in detail on the base of the real case anddata. It exposes the disadvantages of the community correction in China: 1. Socialacceptance is not high; 2. Rectifies the object scope to explore the rationality; 3.Community correction measures needs to be diversified; 4. The communitycorrection work lack of strength, and quality is not high. In view of the aboveproblems, the article on the back part will put forward the author shallow sound advice and recommendations, including: 1. To improve the public for communitycorrection accredited degree; 2. To improve the community rectifies the objectadjusted range; 3. To reform the original single community correction mode; 4. Toexpand community correction workers and improve the quality of staff.In view of the community correction system, the development of our country isinadequate, so this paper, basing on the study of the foreign institutional researchesand combing our country reality, try to explore new concepts and conforms to thenational conditions of our country, and then receive a valuable conclusion.
