Legislation Mode And System Selection Of Chinese Energy Law

Energy is the basic condition for the survival of mankind and social development,it is the life blood of the world economy，and it is also an important factor foraffecting national security. Energy is a topic of common concern of all mankind. Asan important physical base for the development of humanity economic society and theimportant material guarantee for state economy and social security. Without thesustainable development of energy, the sustainable development of economy andsociety is impossible to realize.In the twenty first century when the economy develops in high speed, energyresources have become the problem the whole world and people commonly concerned.In other words, it has become the strategic issues of the people’s livelihood andsustainable development of economy. It is the common measurement for each nationto regulate the energy exploration and utilization using the law to modulate andresolve the energy problems. Countries in the world during the process of energylegislation, without exception, the establishment of the legal system of energy,innovation, perfection of legislation become the important tasks. Since the oil crisisbroke out in1970s, each developed country in the world has speeded up the energyresources legislation processing, and also, China has issued Electric Power Law, CoalLaw, Energy Conservation Law, Renewable Energy Law. However, along with thespeed of the processing of building a harmonious society accelerated, Chinademanded highly for the production and consumption of energy resources.In the context, in order to grasp an overall knowledge of energy, the author firstmainly introduced the related basic knowledge and theoretical of energy, while thesituation of China’s energy use is described. On the basis of this, the author analyzedthe condition of China’s energy legislation, obtained that the legislative system is notcomplete and lack legislation and other defects of the important energy varieties stillexist in our country energy legislation, this means our country must establish EnergyLaw. The legislative mode selection and system selection are the more important two parts. Although other developed countries’ legislative mode for China offered legalachievements, it is not suitable for our country’s actual situation. At present, Chinashould now focus on actively develop energy of the basic law, modified the existinglegislation, and create the law of the oil, natural gas and other areas. In the part ofsystem selection, through collection, analysis at home and abroad especially in USA,Germany, Japan and other developed countries in the energy legislation questionresearch, analysis and comparison, the author think that should develop energystrategy and planning system, supervision system, safety system, price and taxationsystem, total quantity control system and the system of legal liability in China.
