Discussion Of The Construction Of Chinese Energy Resources Law System

Energy resources are the kind of material resources providing a proper sort of energy to the human. Its developing direction is the key issue for determining whether human society will advance smoothly and better in the future. In the twenty first century when the economy develops in high speed, energy resources have become the problem the whole world and people commonly concerned. In other words, it has become the strategic issues of the people's livelihood and sustainable development of economy. As the country with the most population in the world and highest developed speed among the developing countries, China is facing a serious challenge of energy resources shortage. While the economy of China is developing in high speed, consumption of energy resources is soaring. For instance, the energy consumption gross in the last five years surpasses the gross of the past twenty years before the last five years, showing that the Chinese dependence on the energy more and more intense. It is the common measurement for each nation to regulate the energy exploration and utilization using the law to modulate and resolve the energy problems. Since the oil crisis broke out in 1970s, each developed country in the world has speeded up the energy resources legislation processing, and also, China has issued Electric Power Law, Coal Law, Energy Conservation Law, Renewable Energy Law. However, along with the speed of the processing of building a harmonious society accelerated, China demanded highly for the production and consumption of energy resources. China has relied heavily on the policy adjustment on energy resources and resources, ignoring modulating them with law. The policy adjustment is flexible and unstable, lack of ensuring with force, and can not be carried out well, thus, China need to establish the energy resources law system ensuring energy resources safety and enhancing the efficiency, which is the demand of governing the country according to law and building a socialist country ruled by law, and comprehensively implementing the scientific concept of development, and building resource conservation and environment friendly society. Under this circumstance, the author investigates the issues of the law system, collect and analysis the basic energy resources law in and out of China to review and compare the practice of legislation in China and foreign countries. Thus we can study the experiences of other developed countries, such as United States and Japan, to address the necessity of legislation, consistent with the situation of China, of energy resources in our country, and to choose the legislation model of our energy resources law system. It is suggested to build a law system according to Constitution, heading with Energy Law, compensated with Coal Law, Petroleum and Natural Gas Act, Atomic Energy Act, Electric Power Law, Energy Conservation Law, Renewable Energy Law, Energy Reserves Law etc, and with improved and detailed rules, hoping to provide the theory and use for reference for Chinese energy resources law system.
