Research On Legislation Of Rural Energy In China

In developing countries, cities often have priority over rural areas for energy supply. Energy supply in rural areas mainly relies on the local natural resources. And a large population of rural residents in the circumstance of progressive development can causes the massive growth in demand. The contradiction between that and lack of local energy supplies becomes serious day by day. Among numerous factors holding back the development of rural energy in China, the most negative factor is the system and content of legislation of the rural energy. Therefore, research on the legislation of rural energy has become the key mission of promoting the development of the rural energy.On the need for rural energy legislation mainly reflected in protecting China's energy security, and solving the energy fairness problem, developing the rural economy, and promoting rural social progress, and improving the rural environment, as well as effectively solving the inherent lack of legislation on rural energy. At the same time, China's rural energy legislation is based on three major areas: theoretical basis, industrial basis and policy basis. Then, the paper established principles of China's rural energy legislation, such as encouraging and supporting, sustainable development, balanced development.After analyzing legislative necessity, legislative basis and establishing legislative principles, the paper puts forward constructing the Law of Rural Energy from the basic concepts, basic structure, basic system, and administrative department. For the basic concepts, the paper starts from the academic definition and legal definition, then choses a defined way to determine the scope of energy, and establishes the three concepts which should be reflected in legislation. Then, the paper puts forward the basic structure of the law. Then, the paper establishes seven basic system of the law, such as production permission, quality certification for energy saving, examination and approval of key projects. Then, the paper proposes the suggestion for the administrative system for rural energy.Then, the paper suggests that constructing legal system of rural energy should include two level. They are the basic law and other laws and regulations. Finally, the paper points out that it is necessary to amend the relevant laws and regulations, such the Law of Mineral Resources, the Law of Water.
