With acceleration of the economic globalization, the group of scientific and technological talents, as a kind of strategic resource, determines the development of national science and technology. States have been scrambling for high-tech talents in attempt to keep the edge of talent resource. Therefore, the flow of scientific and technological talents ends up with the necessary consequence in the social development.Since the21st century, the flow of scientific and technological talents with more frequency and swelling realm can be seen everywhere between different nations, regions and industries. It indicates that the development of economically social society, on one hand, provides the scientific and technological talents with more opportunities to realize their social and own value. On the other hand, it also produces fresh challenges to the management of the flow of scientific and technological talents regulated by the government. Harmfulness to society caused by the irrational and disorderly cases in the flow which mainly comprise personnel disputes attributed to the changing status in the flow, more contentious affairs related to intellectual property and the unbalanced human resources distribution in regions, has been emerging gradually, due to the increasingly intense flow of scientific and technological talents.The article, by means of regarding law issues in the flow of scientific and technological talents as starting point, firstly analyze the historical reasons of those issues and summarize the defects in the management of the flow of scientific and technological talents through legislative analysis. And then the article explores the advanced experience in the management of the scientific and technological talents in the typical foreign developed countries and puts forward the role and functions of management staffs in the flow of scientific and technological talents. The article concludes that the improvement and innovation in the law system and personnel management just serve the effective resolutions to those problems, which have been elaborated in the final part of it.
