The issue of people’s livelihood is the problem of existence and development. Under the grounds of modern society ruled by law, the protection of people’s livelihood needs the power of law more than anything. Construction of people’s livelihood in China pays more attention on basic rights of existence, for example the rights of working and social security, and these rights are the minimum protection of people’s livelihood. But on the other hand, the rights of development, as a higher tier than the rights of existence, is inadequate in protection of law. As the development of the economy and society in China, the issue of development has been becoming a more topic of people’s livelihood. Basically, the issue of people’s livelihood is a economic problem--a concept of distribution of economic resources. Unfair phenomenon in people’s livelihood originally comes from unfairness of distribution of resources. In the assumption of scarcity of resources, market competition is an important mechanism to promote the distribution of resources fairly. In this opinion the procedure and result of market competition is an effective method to solve the unfairness in people’s livelihood. Undoubtedly, the competition law that aims at protection and promotion of competition is an essential tool of law in construction of people’s livelihood.In the examples of developed countries, the construction of people’s livelihood is regularly materialized into protection of consumers’rights under the background of law. In other words, the realization of people’s livelihood is reached by protection of consumers’rights. What we talked about above is determined by the goal of competition law that includes the maintenance of competitive order and competition, elevation of economic efficiency, and finally the protection of consumers’rights. To reach this goal, the developed countries construct their competition law by concentration of consumers’rights. And in practice these work to protect consumers finally change into people’s livelihood. In my opinion, the structure of consumers’ rights protection is an important part of people’s livelihood in developed countries.In the review of protection of people’s livelihood in China, there are many problems including the aspects of Antimonopoly Law and Combating Unfair Competition Law that relate with civil and administrative as well as criminal responsibilities. These problems are the limitation of function of competition law in protection of people’s livelihood. These problems are not only barricades of consumers’ rights protection and also harmful to construction of people’s livelihood. To perfect these problems we should, in my opinion, improve our competition law in aspects of legal responsibilities and lawsuit system to work the function of competition law in protection of consumers’ rights and finally people’s livelihood.
