To Discuss About Defining The Crime Of Food Security Regulator Misconduct And Imrpoving Problem

With the development of market economy, both commercialization and socialization of food are continuing to deepen. Food safety has also become an important part of public safety. In recent years, the food safety issues which endanger both the physical and mental health of people occurred frequently. The reason for this problem is mainly associated with the carelessness and negligence of regulator and watchdog of food security, except some merchants is willing to neglect the health of people and the law for the high profit. This article took the "slim-pork" as an example, and analysed the details and the court-results, especially compared the similar crimes in the crime of dereliction of duty by further analysing the newly added part in Criminal Law Amendment Eight, which includes analysing the contents of Food Safety Regulatory Offence of Misconduct and the problem of the existence of this crime. At the same time, this article explained the importance of setup this crime based on the reality of our country. Besides, this paper put forward some advices that how to improve the definition and content of this crime through combining the existing law system of our country with the food security reality.
