The Operation Of The Rural People’s Mediation,Limits And Improvement

System of people’s mediation, rooted in Chinese traditional litigation-stopping culture, is a dispute resolution of non-lawsuits which originally created by Chinese people to deal with conflicts and disputes. Compared with any other system, System of people’s mediation appears to excellent in autonomy, sociality and flexibility, making it play an important role in development of our economy and society, for which the authority worked out People’s mediation law of the People’s Republic of China to stipulate its property, goal, principal, organization form, mediator election, meditational procedure and its effect. However, nowadays, our economy and society are in transitional period, and a variety of social conflicts are on eruption, which prevents and challenge the development of system of people’s mediation. Therefore, the study on people’s mediations to overcome and the maximum effort to exert, which has profound significance on solving the basic contradictions and establishing a harmonious society.This thesis studied on H town in X city of Hubei province. H town as a common town in the middle area, possess the feature of rural development, meanwhile, the advantage of location and influence of policy carried out by our country to the native area are the epitome of the rural development during the transformation. On the basis of the investigation, first of all, the writer demonstrated the background and significance of the study, introduced the literatures that existed at home and abroad briefly and described the methods of this study. On the other hand, the writer analyzed people’s conceptions and figures about mediation, arranged the historical development of the china’s special mediation system from the aspects of rudiment, establishment and development. Third, to H town as an object of study, combined with the new features of the new era rural social conflicts and disputes through the typical case, the run status of the analysis of rural people’s mediation and its inadequacies. Finally, the problems in the current during the operation of the rural people’s mediation put forward improvement opinions and suggestions.It believed that traditional organizational support and sources could not meet the needs of disputes solution because of complicated themes and various forms of current conflicts and changing interests’structure. Diversification of social interests, increase of people’s right safeguarding consciousness and limits of the system make it in trouble. Therefore, to improve system of people’s mediation, we should standardice its operation, strengthen construction of people’s mediation organization and troops, ensure the expenditures and push the effective join with litigation.
