On The Community Correction In China And Its Improvement

Nowdays,Community Correction System has become the representative in the development trend of execution.In the social context of reform and opening up, Stepping up the pace as soon as possible to carry out community correction,and vigorously promote the reform and innovation of China’s execution is the general trend.July10,2003,the Supreme Court and the Supreme People’s Procuratorate, Ministry of Public Security and Ministry of Justice issued a notice whose name is On the Community Corrections,So,parts of the countries beginning the work of Community Correction in advance.As time goes on,February25,2011,the19th meeting of the11th National People’s Congress Standing Committee adopted the Chinese people of the Republic of the Criminal Law Amendment (No.eight), the amendment explicitly put forward the implementation of Community Correction is sentenced to control,probation and of the criminal who was convicted parole.January10,2012,for the further specification of Community Correction and to strengthen and innovative the management of special populations,the Supreme People’s Court, Supreme People’s Procuratorate and the Ministry of Public Security,Ministry of Justice jointly developed The Measures Of Community Correction Implementation,it is made a comprehensive specification about the Community Correction Systems and working procedure.This article is divided into six parts.The first part is the introduction,including the issues raised and research significance,the research status and main research methods.Then,an overview of the Community Correction system to analyze the nature and characteristics of the Community Correction System and the concept of Community and Correction and Community Correction System;Then,to describe the origin and development of the Community Correction system and a variety of theoretical basis and system advantages and weaknesses to introduce the basic theory of Community Correction system;Second,by reviewing the history of China’s Community Correction System,as well as the main task,the main purpose,application objects and the basic process to introduce the history and current situation of China’s Community Correction System,then, by analyzing the problems on legislation,implementation,content in China to find a reasonable and effective solution; Then,by introducing the advanced experience of the foreign Community Correction System to analyze what we should learn from them,especially United States,Britain and Japan. Finally,To learn the successful experience and to combine the current status of China’s Community Correction System to make some suggestions,including the improvement of legislation,change the implementation of concepts as well as the professional teams building.
