China’s Current Community Correction System Reflection And Perfection

China’s new criminal law 258 th stipulation provides: " In accordance with law, the criminals sentenced to public surveillance, probation, parole or temporary execution outside prison are supervised by community correction system, which is implemented by community correction agencies." This means that the community correction is established in the form of legislation as a new criminal justice and crime prevention model for the first time, which is regarded as a milepost on the development of community correction system. The improved the legal system provides a strong backing and protection for community corrections; the development of community correction system is a necessary requirement of democracy and the rule of law development, and it is also a symbol of social civilization and progress.But the community correction in China is still at an initial stage, there are still a lot of theoretical and practical problems need to be explored and studied. In practice, the short preparation time, incomprehensive legislation,social environmental constraints and other issues cause the plight of Community Correction, even adversely affect the exercise of the jurisdiction of the judge. The administrative department of justice does not have powerful means of punishment in the implementation. Some community staff disobey the order and take bribe.According to the problems above, the writer puts forward some suggestions, which include further improving of legislative system at the macro level, standardizing of the work mode in the operational mechanism for the realization of the administrative department of seamless docking; regulating pre-trial social investigation methods of evaluation to avoid interference with the exercise of jurisdiction, enriching the means of management, and improving the supporting facilities and so on. The writer believes that with the continuous improvement of legal system the community correction system will be suitable for the situation of our country and play an increasingly important role.
