People-oriented Value Orientation Research Of Chinese Characteristic Socialism Law

The process of legal system in China is continually promoted ahead, and legalconstruction has achieved fruitful results. However, in legal practice, there are stillsome problems which need to be analyzed and solved. If these problems are foundby hard and thorough search, it is not difficult to find the crux lies in what kind oflegal value orientation we are holding in the Legal practice. the Third PlenarySession of the Sixteenth Central Committee put forward the" people-oriented"scientific outlook on Development, which has great guiding significance. Manyscholars have made the preliminary discussions on how to use the" people-oriented" value orientation to guide the legal practice in China, but most are aboutone aspect, lacking of systematic and in-depth demonstration. Therefore, it has veryimportant practical significance and theoretical value to deeply analyze the"people-oriented" value orientation of law, and give it accurate and richconnotation in order to better guide the legal practice.This paper is divided into the following four parts:The first part is the explanation to the " people-oriented" concept. This partdemonstrate and analyze the "people-oriented" theory’s cultural origins, theoreticalreference and theoretical basis. By comparing the" people-oriented " theory withChinese traditional thought of the people and the western humanism, wesummarizes the concept of contemporary" people-oriented" theory, which lays thefoundation for our further understanding of" people-oriented" legal valueorientation.The second part is to analyze the weakening of Legal value orientation inLegal practice and its reasons. To analyze the present legal deficiencies, and itscause to better carry out the " people-oriented" legal value orientation.The third part: It is with the person this" legal value orientation and the basicrequirements of the meaning of the time. In China characteristics socialismconstruction of the rule of new period,"it is with the person this". The fourth part is about how to implement the law practice of “people-oriented” value orientation featuring the Chinese characteristic socialism. People-oriented" legal value orientation is analyzed from three aspects: legislation, the lawenforcement and judicature. Only in this way, can our law construction truly reflectthe " people-oriented" legal value orientation.
