The Detection And Control Of The SMS Fraud Crime

With the continuous development of technology and society, themeans of crime has constantly changed. The current crime presentscharacteristics of intelligence, covert and systematization, which greatlyincreased the difficulty of the cases detected. In recent years, the SMSfraud as a new form of crime spread rampantly in China. Though thepublic security organs continuously blow, a huge temptation entices thefraudsters to continue to take the risk, making the security of the people’sproperty facing a huge threat. How to combat and prevent the SMS fraudis an urgent problem before us. Through the study of SMS fraud theory athome and abroad, and according to the status of China’s legislation andpractice, this paper explores and analyses the SMS fraud in detail, so as tobenefit the detective study of the SMS fraud.This paper has four parts. The first part provides an overview of theSMS fraud, summarizes the common forms of fraud SMS and define itsconcept, and then analyze the SMS fraud’s characteristics and types. Thesecond part discusses the crime law of SMS fraud and such cases’detection difficulty. By the in-depth analysis of its crime law, this paperform a comprehensive and deeply understanding to SMS fraud, and thenanalyze the detection focus and difficulty of such cases, so as to taketargeted investigative measures and break detection difficulty. The thirdsection discusses the specific investigative measures. Starting from the two detection channels, we choose the investigative measures. The forthpart discourse on the prevention and control of SMS fraud. We firstanalyze the reason for the SMS fraud. The primary one is the hugetemptation, and another one is the vulnerability in our country’stelecommunications and financial management and the deficiency inlegislation. Then we introduce the foreign experience and measures, so toprovide reference for the construction of china’s prevention and controlmeasures. Finally, we put forward specific recommendations for the SMSfraud prevention and control.
