On Legal Problems Of The Long-acting Development Of Country Banks

In order to solute the problems of the shortage of finance and theinsufficiency of competition in the countryside, fully develop Chinesecountry finance, and support the “the three rural” as well as thedevelopment of minor enterprises, our state has started the incrementreformation of country finance institutions since late2006. Country banksconsists the main force of this new reformation. More than440countrybanks have been existed all over our state until the end of the first quarterin2011. However, being a new object, the development of country banks isstill preliminary and the immaturities will surely be exposed in theoperation course later on. Under the background of market economy,normal operation of market-subjects has to rely on the restraint andgovernance of various valid regimes, especially legal regimes.This thesis main introduces the theoretical framework of countrybanks, the existing legal system and the current situation of operation. Andstill, according to the introductions above, this paper will providesuggestions on how to realize the long-acting development of countrybanks.This paper can divide into four chapters:The first chapter is about the introduction of the theoretical frameworkof country banks, which will introduce the background of development, thedefinition, the characteristic, the nature and the necessary development ofcountry banks. Besides, the compere between country banks and othercountry finance institutions will discussed in this chapter.Chapter two introduces the existing legal system and the currentinstitution of country banks, puts the legal system into shape, analyzes thedefects of current legal system from aspects of building, operating and supervising regimes, and makes an analysis combining the currentmanagements of country banks.Chapter three focuses on the regime of country banks abroad mainlyfrom their operation pattern to their legal systems, and concludesexperiences which can be studied by Chinese country banks.The last chapter introduces the perfection of legal systems of thelong-acting development of country banks. Through the leadingconsideration of establishment, the construction of building regime, theoperating and supervising regime, this chapter will give some advicehoping to promote the long-acting development of country banks in China.
