On Legal Protection Of The Sustainable Development Of Village Banks

In order to solute the problems of the shortage of finance and the insufficiency ofcompetition in the country side, fully develop Chinese country finance, and support the“the three rural”as well as the development of minor enterprises,our state has started theincrementre formation of country finance institutions since late2006.Country banksconsists the main force of this new reformation.More than749country banks have beenexisted all over our state until the end of the first quarterin2012. However, being a newobject, the development of country banks is still preliminary and the immaturities willsurely be exposed in the operation course later on. Under the background of marketeconomy, normal operation of market-subjects has to rely on the restraint and governanceof various valid regimes,especially legal regimes.This thesis main introduces thetheoretical framework of country banks,the existing legal system and the current situationof operation.And still, according to the introductions above,this paper will providesuggestions on how to realize the long-acting development of country banks.This paper can divide into four chapters:The first chapter is about the introduction of the theoretical frame work of countrybanks,which will introduce the background of development,the definition,thecharacteristic,the nature and the necessary development of country banks.Besides,thecompere between country banks and other country finance institutions will discussed inthis chapter.Chapter two introduces the existing legal system and the current institution ofcountry banks,puts the legal system into shape, analyzes the defects of current legalsystem from aspects of building,operating and supervising regimes,and makes ananalysis combining the current managements of country banks.Chapter three focuses onthe regime of country banks abroad mainly from their operation pattern to their legalsystems,and concludes experiences which can be studied by Chinese country banks.Thelast chapter introduces the perfection of legal systems of the long-acting development of country banks. Through the leading consideration of establishment, the construction ofbuilding regime,the operating and supervising regime,this chapter will give some advicehoping to promote the long-acting development of country banks in China.
