Study On Volunteer Service Legislation

In modern society, volunteer service is not only a noble public welfare, but also the symbol of human civilization and social progress. Recently, volunteer service is growing rapidly in China. In order to regulate volunteer activities, many provinces have issued local laws and regulations. However, volunteer service in China has just started. There are many problems in the development, especially the absence of guidance, management and supervision by government. Volunteer service law which can have nationally standardized potency is most needed.This paper has studied volunteer activities from the perspective of administrative law in four parts. First, describe the legal characteristic of volunteer service’s subject, object, scope, classification and procedures. Clarify administrative law relationship and point out the legal effects and administrative relief way after volunteer activities occur. Second, sum up local laws and regulations which have been promulgated in China as of December2011. Analyze various related systems which have been set up and point out the achievements and weaknesses in local legislation of volunteer service. Third, introduce legislation of volunteer service in the U.K., the U.S., Germany and Japan. Sum up characteristics of legislation systems in these countries accordingly. In the end, legislative suggestions are given with respect to weaknesses in local legislation of volunteer service in China mentioned in the second part.
