The era of globalization is witnessing increasingly sweeping changes in home andabroad, which poses us a series of questions to answer. Among which a new trendtowards legally allowing dual nationality in many countries as the focus oflegislative amendments has aroused attentions of domestic scholars and researchers.Is it necessary and possible for China to follow suit? if so, how? To answer thesequestions, a lot have been done. Based on other scholars’ achievements, myargument is constituted that we should allow dual nationality in China as othercountries have done, and in amending the law, we should draw on the experience ofother countries as well as consider the Chinese current domestic situations.In this paper, I make my argument in the following three steps. In the first section, Iexamine the concepts and development of phenomenon of dual nationality, as well asthe process of allowing dual nationality in laws. In the second section, I examinethree typical countries, the United States, Germany and Italy, on why and how theyallow dual nationality, and then analyze the merits and demerits of their forms andnorms of dual nationality. In the last section, I examine the background of Chinanationality law on disfavoring of dual nationality, then analyze the necessity ofallowing dual nationality in China, finally I put forward my suggestions and viewson the forms and norms about how we recognize dual nationality in China byimporting and transplanting other countries’ dual nationality law.
