On The Status And Improvement Of China’s Community Correction

The study of Community Correction in Western developed countries has a long history of research and practical experience, and it is also a very important and rapid developing non-custodial penalties enforcement regime in the field of criminal justice. From the introduction to development of community correction system in China, it took a very short time accumulating less experience. Although still in the early stages of learning and practicing, the healthy development of community correction system in China has great significance for the transformation of crimes, social stability and unity and national prosperity and stability. Community correction system in China is not yet perfect, and its real development situation is less understood by others. Meanwhile, there still exists a debate in the academic study on community correction theory. The paper consists of four parts, mainly based on field survey data, combining the domestic community correction theory with international ones. The paper will put forwards some adequate suggestions by finding out the deficiency of current community correction system.In the first part, the author mainly illustrates the concept of Community Correction, the theoretical basis of Community Correction, the history of the Community Correction system, as well as introduces the development of community correction in China and the significance of establishing community correction system, all of which outlines the community correction system, clarifies the context of community correction and demonstrates the current environment of community correction; in the second part, the investigation results was revealed and compared including the data of field survey on agencies of community correction, the issues and recommendations raised by the Community Correction staffs, the social awareness of Community Correction and so on, which provides a wealth of material for the following analysis on community correction system; in the third part, with reference to the survey results, the author issued the problems in current legislation, facility construction and enforcement measurements of China’s Community Correction system while describing the deficiencies in details; in the fourth part, with reference to the advanced domestic and foreign theory of Community Correction system, with reference to China current issues on Community Correction system, the author proposed several suggestions for its further development.
