The paper is based on the theory of Emergency Response Plan System of Environment Incident, and follows the method of combining the theory and practice. Using conceptual, case analyze to study Chinese Emergency Plan System of Environment Incident in legal, formulated and executed aspects. From these three aspects I analyze the inadequacies of Chinese Emergency Response Plan System of Environment Incident. Refer to the international experience drawing the conclusion of improvement of the system.The paper is divided into the introduction, body and closing parts.Introduction briefly introduces the meaning of this topic. With the happening of environment incidents and the effect expended, the research is growing. As the result of research and litigation, the system of emergency response plan is formulated approximately. However, Songhua River pollution and Bohai oil spill indicate the system is not perfect. It needs to improve. It’s also very important for ecological civilization and harmonious society.The text is divided into five chapters.Chapter one is a summary of emergency response plan system of environment incidents. At fist I introduce the concept and feature of environment incidents. The concept refers to <National Emergency Response Plan System> and compares to the concept of U.S. Environment Protection Agency (EPA). With the comparison, I draw the feature of environment incident. As an important part of the system, the classification system is also included in the part. Then, from the view of point of concept, factor, type to analysis the emergency response plan system.Chapter two is the analysis of status quo of Chinese emergency response plan system. This part is divided into three aspects. The first is the status of legal system both in comprehensive and single-line aspects. The second is about the status of formulating the emergency response plan. The last is about the execution of emergency response plan svstem. Chapter three is inadequacies in emergency response plan system. This chapter is based on former two chapters. And similar as the Chapter Two, it also divided into three aspects. In the legal aspect, the problem is limiting of laws and regulation. The processes of formulating are unscientific and difficult operation. The problem in execution is relationship between different departments, main single, inadequacies of information disclosure, and weakness of public capacity to respond.Chapter four introduces the international experience. Many countries establish the special laws and found professional departments. At the same time, they pay more attention on cooperation between different departments. In the legal aspect, they establish the law to make sure the public right and information disclosure.Chapter five is the perfection and improvement of the system. Analyze from legal aspect, formulation, execution aspects. At first, in the legal aspect, establish new regulation both in the constitution law and others. Second, in the formulation, focuses on science indicators and operational processes. Last, in the execution, found monitoring system, reinforce corporate role, consummate information disclosure system and strengthen the public capacity.In the Conclusion part, the consummation of emergency response plan system is a long period needs the exploring and practicing chronically. With the rapid social development, the emergency response plan system lagged the society. And the emergency response plan system is not an isolated part. The perfection needs the public power. This study also needs more exploration.
