Coming into this century, China has gradually entered the aging society, the elderly population increased dramatically, resulting a series of elderly social problems. These problems being well or badly resolved, directly affects the stability and development of our economy and society. There is an urgent need of establishing a comprehensive system of protecting the elderly. This article aims to study the basic theory and value of protecting the elderly, and learn from extraterritorial legislation, then try to establish a better system of protecting the elderly. The author tries to describe it with five parts.The first part aims in defining some basic concepts, including the rights of the elderly and law system, followed by a study on the nature and value of the elderly right protecting system to show its importance and necessity. The second part focuses on analysis of problems and defects of its existence of the elderly right protecting system in China, from the angles of legislative level and practice level. The third part provides a summary comparison of various local laws and regulations relying on the central law, mainly from the angles of the content and structure. The fourth part is the reference to the useful experience of some other countries. Taking the impact of culture into account, this article selects South Korea and Japan as subjects, trying to make enlightenment from South Korea elderly welfare Act and the Protection of the Rights and Interests of the elderly in Japan. The fifth part tries to put forward some suggestions on the construction of the Legal System of the Protection of the Rights and Interests of the Elderly in the current situation in China, on the basis of former four parts, respectively from the frame system, the specific content and the improvement of the supporting systems.
