On The Legislative Protection Of Voluntarty Service Rights

Voluntary service is an important avenue to involve himself in society andprotect the interest of vulnerable groups. The right to voluntary service could deepenthe basement of voluntary service and resolve the basic problem of legislative issues.It contains two parts, one is that everyone has the right to help other people throughvoluntary service, the state and society should create conditions to realize the right;the other is that everyone could enjoy the helping right from country、society、andother people. The definition integrates volunteers and voluntary service perfectlyfrom the perspective of volunteers and volunteer service.The provinces、municipalities of China have the legislation on voluntary service,but it wants legislation nationwide, so it is disadvantageous to ensure volunteers’interest. Besides, our legislation exists a series of problem, for example, the subjectof voluntary service is too single; the regulations of liability is too simple; thenature of voluntary service organizations is not clear; the limitations of volunteers’liability and volunteers service abroad are incomplete. These problems affectvolunteers’ legal interest and the sustained and healthy development of voluntaryservice. We should improve the legislation of voluntary service to make up legislativedefect of voluntary service、resolve the problem of voluntary failure and carry forwardtraditional culture. For this, we should ease the age conditions of the volunteers torealize the nationwide of volunteers; define the voluntary service organizations’nature to bring about its independence; set the liability in detail during the process ofvoluntary service to safeguard volunteers’ legal interest; establish the system ofvolunteers’ liability limitations to inspire people participate in voluntary service;build the regulation of voluntary service involving foreign nationals to implement theconnection of foreign voluntary service regulations.
