A Research On Dong Biwu’s People Justice

Dong Biwu is not only proletarian Revolutionaries but also a politician in China; he had nearly devoted his whole life to the Chinese liberation and the construction of People’s Republic of China, especially in the field of laws. Focusing on People Justice, he did a lot of fruitful work. He is one of the principal founders of legal construction of China. The People Justice is a series of scientific law theories which can stand the test of time and practice, which was put forward by Dong Biwu when he had been contacting the legal theory of Marxism-Leninism with the concrete practice of Chinese revolution and socialist to find ways for the socialism legal system. It enormously enriches the law science of Marxism-Leninism and Mao Zedong, and is still of great theory and the practice significance in building socialism country under the rule of laws of today.From a dialectical and comprehensive viewpoint, the thesis studies the forming and development, basic content and value of Dong Biwu’s People Justice systematically.This article is divided into five parts:The first part is introduction, briefly describes the status on this study, the significance of research methods and focus of this article, difficulty and innovation.The second part described the generation and development of Dong Biwu’s People Justice. It analysis the origin and the development process thoroughly of the theory, considering historical perspective with Dong Biwu’s personal experience together.The third part concluded the basic content of Dong Biwu’s People Justice, As a central thought of Dong Biwu’s legal thought, it is summed up as following aspects:first, the realization of the people’s democratic dictatorship is the main task of the People Justice; the second judicial team is a source of judicial power of the people; the third, establishment and perfect the judicial organ and system are important protection for People Justice; the forth, mass line is the fundamental route of People Justice.The fourth part is talking about the value of Dong Biwu’s People Justice, which has been the treasure trove of legal theory of Mao Zedong, and it is also ideological Origins of the rule of law theory of socialism with Chinese characteristics. In addition, Dong Biwu’s People Justice has a strong practical guiding significance, not only promoting the construction of democratic revolution base areas during the rule of law, but also promoting the rule of law in the new China, and what’s more, it provides a theoretical basis of building a socialist society in the new period.The fifth part is conclusion. With the spirit of rigorous scientific attitude, a dialectical analysis of the historical limitations of the Dong Biwu’s People Justice is given.
